Avoiding the appointment of a Provisional Liquidator

NDP is presently advising a substantial trading Company on applications against it which the Company became aware of only 3 days before the hearings.

The applications sought the appointment of a provisional liquidator to the Company and the winding up of the Company on the grounds that its business is carried on contrary to the public interest. Such an appointment would have the effect of killing a successful business.

NDP negotiated with the Solicitors to the department of Business, Innovation and Skills (‘BIS’) in that 3 day time window and avoided the appointment of that Provisional Liquidator, after instructing one of NDP’s key – contact Barristers to represent the Company at the hearing.

The Company now has the opportunity and time to properly prepare its Defence case.
